Nach \u00a7 12 Abs. 1 und 2 HinSchG m\u00fcssen Arbeitgeber grunds\u00e4tzlich eine interne Meldestelle einrichten, wenn sie regelm\u00e4\u00dfig mindestens 50 Besch\u00e4ftigte haben. Diese allgemeine Schwelle ist bei GermanSTS nicht erreicht. \u00a7 12 Abs. 3 HinSchG enth\u00e4lt besondere Ausnahmen f\u00fcr bestimmte regulierte Unternehmen, f\u00fcr die die Pflicht unabh\u00e4ngig von der Besch\u00e4ftigtenzahl gilt; nach der Gesch\u00e4ftst\u00e4tigkeit als Anbieter von Kabeln und Netzwerktechnik f\u00e4llt GermanSTS nach derzeitiger Kenntnis nicht in diese Kategorien. Deshalb wird derzeit kein interner Meldekanal auf diesem Shop bereitgestellt. \u00c4ndern sich Besch\u00e4ftigtenzahl oder T\u00e4tigkeitsbereich, wird die Pflicht erneut gepr\u00fcft und ein erforderlicher Kanal eingerichtet.<\/p>\n<\/section>\n<section class=\"gr-section\" id=\"de-reporting-2\">\n<h2>Externe Meldestellen<\/h2>\n<p>Hinweisgebende Personen k\u00f6nnen unter den gesetzlichen Voraussetzungen zwischen einer internen und einer externen Meldung w\u00e4hlen. Eine externe Meldung kann an die f\u00fcr den jeweiligen Sachverhalt zust\u00e4ndige Meldestelle gerichtet werden. Die externe Meldestelle des Bundes beim Bundesamt f\u00fcr Justiz (BfJ) nimmt Meldungen in ihren gesetzlichen Zust\u00e4ndigkeitsbereichen entgegen und informiert \u00fcber Zust\u00e4ndigkeit und Einreichungswege: <a href=\"https:\/\/www.bundesjustizamt.de\/DE\/MeldestelledesBundes\/MeldestelledesBundes_node.html\" target=\"_blank\" rel=\"noopener\">BfJ \u2013 Externe Meldestelle des Bundes<\/a>. Vor einer Meldung pr\u00fcfen Sie bitte dort, ob das BfJ zust\u00e4ndig ist oder ob eine andere gesetzliche externe Meldestelle zust\u00e4ndig ist. Eine externe Meldung setzt nicht voraus, dass zuvor intern gemeldet wurde.<\/p>\n<\/section>\n<section class=\"gr-section\" id=\"de-reporting-3\">\n<h2>Schutz und Vertraulichkeit<\/h2>\n<p>Das HinSchG sch\u00fctzt hinweisgebende Personen vor Repressalien, wenn seine Voraussetzungen erf\u00fcllt sind. Eine Meldung betrifft Informationen \u00fcber Verst\u00f6\u00dfe im beruflichen Zusammenhang, die in den sachlichen Anwendungsbereich des Gesetzes fallen. Falsche Tatsachenbehauptungen oder Meldungen au\u00dferhalb dieses Anwendungsbereichs sind nicht automatisch gesch\u00fctzt. Da GermanSTS derzeit keinen internen Meldekanal betreibt, kann dieser Shop keine vertrauliche Entgegennahme oder Bearbeitung interner Hinweise gew\u00e4hrleisten. Under section 12(1) and (2) HinSchG, employers generally must establish an internal reporting office if they normally have at least 50 employees. GermanSTS is below that general threshold. Section 12(3) HinSchG contains special exceptions for certain regulated businesses, for which the duty applies regardless of employee count; based on its current business as a cable and networking supplier, GermanSTS does not appear to fall within those categories. No internal reporting channel is therefore provided on this shop at present. The obligation will be reviewed if the employee count or business activity changes, and a required channel will then be established.<\/p>\n<\/section>\n<section class=\"gr-section\" id=\"en-reporting-2\">\n<h2>External reporting offices<\/h2>\n<p>Subject to the statutory conditions, reporting persons may choose between internal and external reporting. An external report may be sent to the office responsible for the matter. The Federal Government\u2019s external reporting office at the Federal Office of Justice (BfJ) accepts reports within its statutory remit and explains its jurisdiction and submission channels: <a href=\"https:\/\/www.bundesjustizamt.de\/DE\/MeldestelledesBundes\/MeldestelledesBundes_node.html\" target=\"_blank\" rel=\"noopener\">BfJ \u2013 Federal external reporting office<\/a>. Please check there whether the BfJ or another statutory external office is competent. External reporting does not require a prior internal report.<\/p>\n<\/section>\n<section class=\"gr-section\" id=\"en-reporting-3\">\n<h2>Protection and confidentiality<\/h2>\n<p>The HinSchG protects reporting persons from retaliation where its conditions are met. A report concerns work-related information about breaches within the Act\u2019s material scope. False factual allegations or reports outside that scope are not automatically protected. As GermanSTS does not currently operate an internal reporting channel, this shop cannot provide confidential receipt or handling of internal reports.
